1. About Kivo and these Terms

These Terms of Service ("Terms") govern your use of the Kivo platform ("Kivo", "the Service") operated by Kivo Technologies Ltd, a company registered in England and Wales (Company number: 16528232), with its registered address at 128 City Road, London, United Kingdom, EC1V 2NX.

By accessing or using Kivo, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

These Terms apply to all users of Kivo, including home buyers using the free consumer service and mortgage advisors using the paid advisor platform.

2. Eligibility and account use

To use Kivo you must be:

• At least 18 years of age
• A resident of the United Kingdom
• Accessing the Service for personal, non-commercial use (unless you are a registered advisor)

You are responsible for ensuring that all information you provide to Kivo is accurate and up to date. Providing false or misleading information may result in an inaccurate Kivo Score and could constitute a breach of these Terms.

You must not share access to your Kivo account with any other person. You are responsible for all activity that occurs under your account.

3. The Kivo service

Kivo provides a mortgage readiness assessment tool that generates a personalised "Kivo Score" (1–100) based on information you provide. In future, this may also optionally include financial data accessed via Open Banking, once that feature is available. The Service also provides:

• Educational information about mortgages and the home buying process
• Calculators and tools to help you understand your financial position
• The ability to connect with FCA-regulated mortgage advisors (subject to consent)
• An advisor portal for registered mortgage advisors (paid subscription required)

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will endeavour to provide reasonable notice of material changes.

4. Important limitations and disclaimers

Kivo is not a mortgage broker and does not provide regulated financial advice. The Kivo Score is an indicative tool only. It is designed to help you understand your mortgage readiness in general terms — it is not a formal assessment of your mortgage eligibility, a decision in principle, or any guarantee that you will be offered a mortgage.

The Kivo Score is generated using AI and algorithmic models that approximate lender criteria. Actual lender decisions depend on many additional factors, including individual lender policies, market conditions, and full affordability assessments that Kivo does not carry out.

We strongly recommend that you:

• Do not rely solely on your Kivo Score when making financial decisions
• Speak to a qualified, FCA-regulated mortgage adviser before applying for a mortgage or making any significant financial commitment
• Verify any information provided by Kivo independently before acting on it

The calculators and tools on the Kivo platform produce estimates only and should not be relied upon for precise financial planning.

Kivo Technologies Ltd is not authorised or regulated by the Financial Conduct Authority (FCA) in respect of the Kivo consumer service. Mortgage advisors listed on or connected through Kivo are independently FCA-regulated. Kivo does not endorse or guarantee the services of any specific advisor.

5. Liability

To the fullest extent permitted by law:

• Kivo is provided "as is" without warranties of any kind, express or implied
• We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components
• We are not liable for any loss or damage arising from your reliance on the Kivo Score or any other information provided through the Service
• We are not liable for any indirect, consequential, or special loss, including loss of profit, loss of data, or loss of opportunity
• Our total liability to you in respect of any claim arising from your use of the Service shall not exceed £100

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

You agree to indemnify and hold harmless Kivo Technologies Ltd and its officers, directors, and employees from any claims, losses, or damages arising from your breach of these Terms or your use of the Service.

6. Your data and privacy

Your use of Kivo is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data. By using Kivo, you consent to our processing of your data as described in the Privacy Policy.

You retain ownership of any personal or financial data you provide to Kivo. By providing this data, you grant us a limited licence to use it to provide the Service.

You may request deletion of your data at any time by contacting privacy@getkivo.co.uk.

7. Acceptable use

You must not use Kivo to:

• Provide false or misleading information
• Attempt to manipulate or game the scoring algorithm
• Access the Service using automated means without our written permission
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Infringe the intellectual property rights of Kivo or any third party
• Transmit any harmful, offensive, or unlawful content
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Use the Service for any commercial purpose without our prior written consent (except as a registered advisor)

We reserve the right to suspend or terminate your access to Kivo if we reasonably believe you have breached these acceptable use provisions.

8. Intellectual property

All content, design, code, and materials on the Kivo platform are owned by or licensed to Kivo Technologies Ltd and are protected by UK and international intellectual property law.

You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written permission.

The Kivo Score methodology, scoring algorithm, and associated models are proprietary to Kivo Technologies Ltd.

9. Advisor accounts

Mortgage advisors who register for a Kivo advisor account are subject to additional terms which will be provided at the time of registration. Key conditions include:

• Advisors must be FCA-authorised and maintain that authorisation throughout their use of the platform
• Advisors must only contact buyers who have explicitly consented to share their data with that advisor
• Advisors must treat buyer data in accordance with UK GDPR and their own data protection obligations
• Advisor subscriptions are billed monthly and are non-refundable except where required by law
• We reserve the right to suspend or terminate advisor accounts if conduct does not meet our standards or regulatory requirements

10. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email (if you have an account) or by displaying a prominent notice on the platform. Your continued use of Kivo after such notification constitutes acceptance of the updated Terms.

We recommend you review these Terms periodically. The date of the most recent update is shown at the top of this page.

11. Governing law

These Terms are governed by and construed in accordance with the law of England and Wales. Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you may also have rights under the law of your country of residence that cannot be overridden by these Terms.
